Pakistan successfully passed the 27th constitutional amendment on Monday, effectively institutionalising military supremacy, sources told News18.
According to top Indian intelligence sources, the central intent of this significant piece of legislation is to formalise the supremacy of Pakistani army chief Field Marshal Asim Munir.
The intelligence sources said one of the most drastic changes brought about by the amendment is the reorganisation of the military command structure. Parliament has legislated the creation of a unified command mechanism, they said.
They said, most importantly, all armed forces will now be under the operational purview of the army chief’s office. This centralisation of command is projected to significantly dilute the existing authority and oversight of civilian defence institutions, thereby enhancing the military’s institutional role, they added.
The sources said the amendment includes strategic measures to prevent political accountability through judicial scrutiny. The legislation provides for the establishment of a federal constitutional court, they said.
They said this new court’s powers are structured to curb the Supreme Court’s ability to review or intervene in political or military matters. This is explicitly characterised as a strategic manoeuvre to neutralise judicial interference when the military is involved in army-backed governance or electoral manipulation, they added.
Further details reveal that legal officers of the Inter-State Intelligence (ISI) were responsible for drafting major portions of the bill, with the express aim of formalising military oversight of the judiciary, the sources said.
On the political front, the amendment also serves as a pre-election control mechanism, they said. It directly limits provincial autonomy and enhances federal discretion concerning key appointments, they added.
This move, the sources said, is specifically designed to manage anticipated provincial dissent, particularly in regions such as Sindh and the restive Khyber Pakhtunkhwa. Together, these changes consolidate a military-dominated regime, a structure deemed beneficial for supporting China’s CPEC (China-Pakistan Economic Corridor) security commitments, they said.
